Richard Epstein on Barack Obama, his former Chicago Law Colleague

  1. Michael,

I loved the comparison to children and sweets, that was rich!

I think Epstein sounds like a thoughtful guy. I am not sure I share his optimism that his constitutional challenges will be successful. What did you think about that assertion?

I noticed that Epstein chides Obama for being brash and egotistical and not consulting with the other faculty enough. I agree with Epstein, this can be dangerous, particularly in regards to a person with as much political power as Obama has. However, Epstein seemed himself to be overly impressed with the virtue of consensus-building. I'm not sure I'm convinced that's a vice-free way of arriving at knowledge, either. What kind of consensus other than a flawed one could ever be reached in, say, a government-subsidized Keynesian econ department? Or a law school, for that matter?

  2. I think Epstein is accurate with respect to the constitutional challenges. Chances are they won't make it but its not inconceivable. I wonder what the conservatives on the Court think of the constitutionality of Obamacare.
